Next Step:At the September 21, 2021, meeting, the Governor and Cabinet approved the Department's request to adopt this rule. The Department will file the rule for certification with the Department of State on October 5, 2021.

Purpose:    The purpose of proposed amendments to 12-9.001 is to better define words and terms used in the certification and training of local officials. (This rule will be renumbered as a technical change from 12-9.001 to Rule 12D-19.011, F.A.C., after promulgation of rules in Chapter 12-9 is complete). The purpose of proposed amendments to Rule 12-9.002 (Amend title to: Certified Florida Property Appraiser, Certified Florida Evaluator, Certified Cadastralist of Florida, Certified Florida Collector, and Certified Florida Collector Assistant Program) is to add Certified Cadastralist of Florida as a certification offered through the Program and to provide that the Department will publish an informational guide regarding the Program. This rule will be renumbered as a technical change from 12-9.002 to Rule 12D-19.012, F.A.C., after promulgation of rules in Chapter 12-9 is complete. The purpose of proposed amendments to Rule 12-9.003 (Qualifications) is to establish updated criteria for the professional certification of property appraisers, tax collectors, their employees, and employees of the Department, and adds the certification criteria for a cadastralist. (This rule will be renumbered as a technical change from 12-9.003 to Rule 12D-19.013, after promulgation of rules om Chapter 12-9 is complete). The purpose of proposed new Rule 12-9.0031 (Approval of Courses) is to provide criteria and procedures for approval of courses for credit towards certification, recertification, or reinstatement of a professional certification, and to incorporate a new form for obtaining approval of a course or continuing education hours (Form DR-4002, Application for Approval of a Course or Continuing Education Credit Hours). (This rule will be renumbered as a technical change from 12-9.0031 to Rule 12D-19.014, after promulgation of rules om Chapter 12-9 is complete). The purpose of proposed new Rule 12-9.0032 (Department Sponsored Courses) is to provide procedures for registrations, payments, cancellations, and refunds for Department-approved courses. (This rule will be renumbered as a technical change from 12-9.0032 to Rule 12D-19.015, after promulgation of rules om Chapter 12-9 is complete). The purpose of proposed amendments to Rule 12-9.004 (Application for Certification) is to specify procedures for those seeking professional certification and to incorporate the form used for this purpose (Form DR-4001, Application for Florida Professional Certification).( This rule will be renumbered as a technical change from 12-9.004 to Rule 12D-19.016, F.A.C., after promulgation of rules in Chapter 12-9 is complete). The purpose of proposed amendments to Rule 12-9.0055 (Amend title to: Fees and Tuition) is to clarify the fee for obtaining and retaining professional certification under the Program and that fees and tuition for Department approved courses may be submitted to the Department online. (This rule will be renumbered as a technical change from 12-9.0055 to Rule 12D-19.017, F.A.C., after promulgation of rules in Chapter 12-9 is complete). The purpose of proposed amendments to Rule 12-9.006 (Certification) is to clarify the certification application approval process by the appropriate Admissions and Certification Committee. (This rule will be renumbered as a technical change from 12-9.006 to Rule 12D-19.018, F.A.C., after promulgation of rules in Chapter 12-9 is complete). The purpose of proposed amendments to Rule 12-9.007 (Recertification) is to provide updates to requirements for all certified professionals to annually certify their governmental employment, to acknowledge the Florida Code of Ethics for Public Officers and Employees that applies to all certified professionals, and to pay an annual recertification fee using the Application for Florida Professional Certification (Form DR-4001). (This rule will be renumbered as a technical change from 12-9.007 to Rule 12D-19.019, F.A.C., after promulgation of rules in Chapter 12-9 is complete). The purpose of repealing 12-9.008 is to eliminate unnecessary rule language regarding the process to request a hearing if an application or reinstatement request is not approved. This language is already in Chapter 120, F.S., and applies here without specific language in the rule. The proposed amendments to Rule 12D-16.002, Florida Administrative Code (Index to Forms), incorporate new Forms DR-4001 (Application for Florida Professional Certification) and DR-4002 (Application for Approval of a Course or Continuing Education Credit Hours). Repealing Forms DR-410, Application for Certified Florida Collector or Certified Florida Collector Assistant, DR-516, Application for Certified Florida Appraiser, DR-516E, Application for Certified Florida Evaluator, and DR-591, Application for Certified Cadastralist of Florida..

Note: The renumbering of all of these rules will ensure consistency with current rule numbering, as all Property Tax rules will be found in Rule Chapter 12D.
